Terms and Conditions
Consumer law:
If you enter into contracts with consumers (i.e. private individuals) in Austria, you are subject to the provisions of Austrian consumer protection law. This means that you must provide certain information about the right of withdrawal, return conditions and liability in the terms and conditions if you offer services such as music sales or tickets.
Right of withdrawal:
In Austria, consumers must have the right to withdraw from certain contracts (e.g. distance selling contracts, online orders) within 14 days without giving any reason. This right of withdrawal must be clearly stated in the general terms and conditions.
E-Commerce Act (ECG):
If you enter into contracts online, such as by selling music or offering gigs, you must comply with Austrian e-commerce law. This includes requirements for providing information on the website, such as your full contact information, tax number and indicating prices including VAT.
Price Indication Ordinance:
In Austria, prices must be displayed transparently on your website, especially if you offer services or products for sale. This means that all prices (e.g. for performances, music sales, workshops) must be stated including VAT.
Terms and Conditions for digital services:
If you offer digital products or services (such as music downloads or streaming), your terms and conditions should specifically address this type of service, as there are additional legal requirements for the use of digital content, such as the right to reproduce and license use.
